Terms and Conditions of Membership
Termination Process
You may terminate this Agreement by written request. Your contract will then expire thirty (30) days from the date of the termination request. Any deduction due during the thirty day notice will be processed as per normal. If we have not received your termination request in writing, your contract will automatically continue.
All membership policies will autorenew unless written notice is given at least 2 weeks before the next billing cycle.
A Terms and Conditions of Use
The following Terms and Conditions govern the rights and obligations between you and Kali Majapahit Melbourne.
B. Use of Kali Majapahit Melbourne
Use of equipment and premises and facilities at Kali Majapahit Melbourne is personal to you and is non-assignable and non-transferable. You shall not permit your membership to be used by anyone else.
Kali Majapahit Melbourne reserves the right, at its sole discretion, to reject your application for use of equipment, premises or facilities for any reason whatsoever and without giving any reason for the rejection.
If you were to cause any damage to any Kali Majapahit Melbourne property beyond regular wear and tear, you will be liable and will be charged for the repair or replacement of such property.
C. Fees
The Fees payable by you are detailed on the Stripe payment link. Once you have completed payment, you shall complete the agreed contractual period or serve the termination notice as detailled in the termination process above.
Fees may be increased or reduced subject to thirty (30) day's notice, at the discretion of Kali Majapahit Melbourne. Kali Majapahit Melbourne is not liable for any compensation to you resulting from such changes.
If you fail to pay the membership fees on the due date, Kali Majapahit Melbourne shall be entitled to suspend or terminate your right to use the equipment and facilities at Kali Majapahit Melbourne under this Agreement. Notwithstanding such suspension, your obligation to pay the Monthly Fees shall continue until this Agreement is terminated.
D. Class Cancellation
Kali Majapahit Melbourne reserves the right to cancel classes on occasion and without notice for reasons including, but not limited to, illness, travel and public holidays.
Kali Majapahit Melbourne may offer make-up classes however, these are not guaranteed.
Kali Majapahit Melbourne will not offer any refund or compensation for cancelled classes.
E. Your Physical Condition And Safety
You understand that it is your responsibility to consult a physician regarding your ability to participate in the physical activities and/or use of Kali Majapahit Melbourne Equipment and Facilities, and that participating in the physical activities undertaken at Kali Majapahit Melbourne and use of Kali Majapahit Melbourne facilities and/or equipment imposes physical demands upon you. In particular you understand that sessions may be conducted outdoors, which may impose extra physical demands on you.
You shall not use any of the Kali Majapahit Melbourne facilities and/or equipment or participate in any of the physical activities available at Kali Majapahit Melbourne whilst suffering from any infections or contagious illness, disease or other ailment including but not limited to open wounds, sores or minor infections, where there is any risk that such use or participation in such condition may be detrimental to the health, safety, comfort or physical condition of other users. You will bring any such matters to the attention of staff of Kali Majapahit Melbourne if in doubt.
Any person who is pregnant, under medication and/or suffering from or having suffered from any medical disability is strongly advised to seek the advice of a qualified medical practitioner before using any of Kali Majapahit Melbourne facilities and/or equipment or participating in any physical activities on the premises whether it be conducted by a Kali Majapahit Melbourne instructor or third party.
No person who is under the influence of drugs or alcohol is permitted to use Kali Majapahit Melbourne facilities and/or equipment or take part in any activities in the premises of Kali Majapahit Melbourne.
F. Limitation of Liability
You should be aware that in participating in the physical activities available at Kali Majapahit Melbourne, and in using Kali Majapahit Melbourne facilities and/or equipment there is the risk of possibility of injury.
You voluntarily accept the risk of injury involved in such participation and use and agree that neither Kali Majapahit Melbourne, nor its/their employees or agents shall be responsible for any claims, demands, damages, losses, loss of profit or business, actions or legal proceedings due to death, injury, loss, damage to your person or property, or to the person or property of other participants in the physical activities available at Kali Majapahit Melbourne; and
You hereby agree to defend, indemnify on demand and hold harmless Kali Majapahit Melbourne, and any of its/their employees or agents from all claims which may be brought against them for any such injuries or claims as foresaid and all costs and expenses incidental thereto.
Kali Majapahit Melbourne is not responsible for any items lost or stolen on its premises for any reason whatsoever. You are solely responsible for taking care of your personal belongings on the premises.
G. Termination by Kali Majapahit Melbourne
Kali Majapahit Melbourne may terminate this Agreement without notice and with immediate effect if your conduct is such that, in the reasonable opinion of Kali Majapahit Melbourne, it may be injurious to the character or interests of Kali Majapahit Melbourne or to other users and members or if you are in breach of the Terms and Conditions as from time to time are in force. All decisions of Kali Majapahit Melbourne under this Clause are final and binding.
In the event of termination, you shall lose all rights and privileges under this Agreement with immediate effect without claim for any refund of your initial Enrolment Fee, or Monthly Fee for the month in which the termination occurs. On termination of this Agreement, you shall immediately forfeit all access to Kali Majapahit Melbourne property and settle any outstanding debts owed to Kali Majapahit Melbourne.
Kali Majapahit Melbourne shall also be entitled to recover from you all costs and expenses incurred in connection with the recovery of the unpaid fees and interests and other losses or damages caused by you on an indemnity basis.
H. Suspension of Agreement by You
You may suspend your account for a maximum of six (6) months if you are have been certified medically unfit to take part in Kali Majapahit Melbourne activities, or for a maximum of two (2) months for any other reasons. The minimum suspension period is 1 month.
No backdated suspensions are allowed.
You will be required to provide a valid reason for the suspension.
Kali Majapahit Melbourne reserves the right to reject any non-pregnancy or non-medical suspensions.
I. Others
Lost property found on Kali Majapahit Melbourne premises will be held by Kali Majapahit Melbourne for a period of seven (7) days, after such time Kali Majapahit Melbourne reserves the right to dispose of the items in any way it sees fit, no claims shall be valid after this period. Items deemed hazardous shall be disposed off immediately and no claims shall be valid.
You must be dressed in the appropriate attire when taking part in Kali Majapahit Melbourne sanctioned activities.
Kali Majapahit Melbourne reserves the right to take photos and video from time to time on our premises, which may be used for marketing purpose.Kali Majapahit Melbourne may at its sole discretion amend, vary, delete or add to these Terms and Conditions with immediate effect. You will be advised of any changes by notification on Kali Majapahit Melbourne's notice board or by written notice.
This Agreement shall be govern and construed in accordance with the laws of Australia.
